These Terms & Conditions and notices contained herein govern your use of
the GearXS.com service and website. By using, visiting, or browsing the
GearXS.com website, you accept and agree to be bound by these Terms &
Conditions. If you do not agree to these Terms & Conditions, you should
not use the GearXS.com service or website.
These Terms & Conditions are an ongoing contract between you and GearXS.com
and apply to your use of the GearXS.com service and website. These Terms &
Conditions affect your rights and you should read them carefully.

GearXS.com reserves the right, from time to time, with or without notice to
you, to change these Terms of Use in our sole and absolute discretion.

the GearXS.com website. Your use of the GearXS.com website or continued use of
our service after changes are made means that you agree to be bound by
such changes.

GearXS.com
Product Pricing and Order Acceptance Policy
GearXS.com reserves the right to change prices at any time. Due to possible
information misrepresentations, we may correct typographical and
printing errors related to prices at any time. Customers should be aware
that product prices can and do fluctuate due to market movements and
stock availability.
In the event a product is listed at an
incorrect price or with incorrect information due to typographical
error or error in pricing or product information received from our
suppliers, GearXS.com shall have the right to refuse or cancel any
orders placed for product listed at the incorrect price. GearXS.com
shall have the right to refuse or cancel any such orders whether or
not the order has been confirmed and your credit card charged. If
your credit card has already been charged for the purchase and your
order is canceled, GearXS.com shall immediately issue a credit to
your credit card account in the amount of the charge.
Your receipt of
an electronic or other form of order confirmation does not signify our
acceptance of your order, nor does it constitute confirmation of our
offer to sell. GearXS.com reserves the right at any time after receipt
of your order to accept or decline your order for any reason.

No Third Party Affiliated stores, websites or any of its providers of information
shall have any liability for the accuracy of the information contained
in the Service, or for delays or omissions therein. None of the
foregoing parties shall be liable for any third-party claims or losses
of any nature, including, but not limited to, lost profits, punitive or
consequential damages.

accurate, nor does the management take responsibility for it. The
information comes from other sources and therefore may be wholly
unreliable, and the management does not guarantee its suitability for

rights are retained by their respective owners, including, but not
limited to, the right of reproduction, the right of distribution, and
the right of passage.If an advertised
product's price varies from the one listed on our

please contact us by phone or e-mail prior to making a purchase.
At times, the final shipping charge for your order
might differ from the approximated charge listed on third party affiliated sites due the
uploading and updating delay time between GearXS.com and the third party site. In such
instances make sure to check whether the listing is for quantity purchases.
Also, though we try to stay consistent, certain zip codes carry significantly
higher shipping charges.

Product Cancellation
All purchases on GearXS.com, GearXS eBay, Amazon, Pricewatch.com and all
our other affiliated stores are final and binding. It is strongly
recommended that all products are fully researched and examined closely
prior to purchasing.
Once an order has been submitted it may not be cancelled or modified if payment
has been processed and cleared and the order has been updated to
'Packaging' or Shipped' status. GearXS.com
reserves the right to charge up to 20% cancellation/restocking fee on all orders that have been
processed or shipped (including refused packages and unopened merchandise).
All purchases on Laptops have a
strict non-cancellation policy. Returns on Laptops will only be approved
if confirmed as defective by a certified technician or was wrongfully
advertised.

Account Access & Identity Protection
You may not share your account with any third party or provide them your
password. Should you decide to share your account with any third party
then you take full responsibility for their actions and you will be
liable for any losses or errors that cause a financial or stock
shortfall on your account.
If you find that your account is being accessed without your consent you
are a victim of identity theft and you should notify customer service as
soon as possible as well as your local law enforcement agency. GearXS.com is
not obligated to compensate members/account holders for losses of funds
due to your account being used without your specific authorization.

Customer
Account Information It
is the responsibility of the account holder to ensure that all
personal account information is accurate and updated at the time of
purchase including the following but not limited to; Phone Number,
Shipping Address, Billing Address, Email Address.
GearXS.com may contact the account
holder either by email or phone number in the event of an out of
stock product, backorder notification, product substitution or other
enquiry. In any case that the account holder is unreachable after 3
failed email or phone attempts the order will either be shipped or
canceled. Final decision will be under GearXS.com total discretion.

GearXS.com General Processing Information
In pursuant to GearXS.com Terms and Conditions, GearXS.com has the right to take
up to seven business days to process any incoming order. GearXS.com will
attempt to fulfill and
dispatch paid orders within 48 hours of receipt of cleared funds into
our bank account. GearXS.com cannot be held responsible for delays in the
banking system, once the funds have been sent we will process the order.
Refunds will not be given for such delays and once money has been
dispatched we will regard the order as confirmed and the sale is final.
All orders placed over the total value of $250.00 requires an order
verification. The account holder will be contacted by our Customer
Service Department to confirm the authentication of the order. The order
will be placed in pending hold until verification of the order has been
confirmed and verified. Canceled orders after it has been placed may be
subject to a 15% restocking fee.
Upon payment being received by GearXS.com, all sales are final. No refund
will be issued. For defective items replacement and repair, please refer
to our
section.

GearXS.com
Shipping Policy
GearXS.com liability on shipment ends once the courier service takes custody
of the item that is at the point of drop off or hand over to the courier
service. If the item is lost from this point onwards, GearXS.com has no
responsibility (unless insurance option has been selected) but will
attempt to investigate or open a lost claim to recover the lost package.
GearXS.com may offer FREE SHIPPING on
certain items. These items are shipped to the customer at no additional charge
as the product is paid by GearXS.com as a courtesy. If a return should take place on a FREE SHIPPING item, the
customer will be charged for the actual shipping and handling costs, a minimum of $5.
FREE SHIPPING offers are
only available to destinations in the continental US.
Free Shipping is not
available on packages shipping to the following; Hawaii, Alaska, Puerto
Rico, APO, Virgin Islands and Guam. An additional shipping fee will be
applied after the order is placed.
Please contact our customer service department at 1-800-438-7516 during our
normal business hours for an accurate final shipping cost to your
destination.
FREE SHIPPING items may be shipped via FedEx, UPS or USPS (First Class or Priority).
GearXS.com reserves the right to substitute
the selected shipping carrier/method with an equivalent shipping
carrier/method.
Estimated carrier shipping time does not include our order
processing time. For example: 2nd Day Air packages may take 3 days to
be delivered to their destination.
FedEx Standard Overnight -
package will be received within 24-48 hours. (all orders placed before 4pm
should be delivered the following day by 3pm).
FedEx Express 2-Day Saver - package will be received within 48-72 hours.
(all orders placed before 4pm should be delivered on the second day by 3pm).
FedEx Standard Ground Delivery - package will be received within 3-6
business days (all orders placed before 4pm should be delivered within 4-7
business days).
FedEx SmartPost Delivery - package will be received within 4-10 business days
(all orders placed before 4pm should be delivered within 5-14 business days).
Failed deliveries by reason of
customer's absence at requested shipping address, or bad address, will result in a surcharge if
reshipped. Failed deliveries will not qualify for a full refund.

GearXS.com
Limited Warranty Coverage
All our products carry a 30 day in-store warranty or are
covered under Direct Manufacturer Warranty unless stated otherwise. GearXS.com sells products in a
variety of conditions such as New Retail Boxed, New - Bulk, OEM,
Refurbished, Used. All product pages are marked with the condition of
the product sold. It is the customers responsibility to read the entire
product page before placing the order. Manufacturer Warranty may vary in
duration from 30 days to 3 years. All products covered under Direct
Manufacturer Warranty must be handled with the manufacturer before
attempting to contact GearXS.com.
The limited warranty covers the following faults described below..
DOA (Dead on Arrival) implies that the product either cannot be turned
on or be ready in use after taking out of the box. Buyer must report
this situation to GearXS.com within 48 hours of receipt. If the item is not
tested or examined by the buyer within the first 48 hours after the
goods are received, the DOA returned policy would not be valid.
No further exception will be considered about the time issue. The 48
hours period starts from the time recorded as 'delivered' in the courier
service's tracking system.
GearXS.com will replace or repair a DOA item, In the event that a
replacement or repair cannot be made due to product unavailability or
any other technical reason, GearXS.com will refund the buyer in full
including the original shipping charges. A repair order may take up to
14 business days starting from the day when GearXS.com received the
defective unit. GearXS.com has the right to make the final decision on
whether a replacement or a repair process should be issued under any
circumstances or situation.
Under any circumstances, GearXS.com reserves the final rights to approve any
DOA replacement or a warranty coverage repair. GearXS.com also has the right
to make the final decision on whether the issue pointed out by the buyer
is considering a defect or not. In the event that a replacement or
repair is not granted to the buyer, GearXS.com will send back the product
back to the buyer; In this case it is the duty of the buyer to cover
shipping costs.
The repair process by GearXS.com may take up to 14 business days upon item
being received from the buyer.
GearXS.com Refurbished 30 Day
Return/Exchange Warranty
GearXS.com specializes in 'Refurbished'
products. Products that were once brand new but have been returned back
to their original retail store or manufacturer for reasons such as
defective, unwanted gift, non-compatibility, company leased product.
GearXS.com purchases these products and run them through testing and QC
inspections for functionality. These products are then sold by
GearXS.com as 'Refurbished' products.
Condition - Refurbished and
Off-Lease products may bear minor marks and scratches or wear and tear
from previous usage or repair. Each product will go through QC
inspections and testing to ensure that they pass GearXS.com's
'Refurbished' conditions and tested for full functionality prior to
shipping to customers.
Warranty - Most products that have
been returned back to the Manufacturer are no longer covered by
Manufacturer Warranty or eligible for warranty repair, these are
typically sold 'AS-IS'. GearXS.com will cover these products for 30 days
starting from the date of confirmed delivery. In the event that the
product is received in a defective condition or fails to operate within
the 30 day warranty period. GearXS.com will honor the product for
replacement, store credit or refund (please read our Returns Policy for
more details).
Manufacturer Refurbished products may be covered by a Limited
Manufacturer Warranty. The warranty can range from 30, 60, 90 or 180
days. All products that are covered by a Direct Manufacturer Warranty
will be stated on the product page. In the event that a product
purchased with Direct Manufacturer Warranty becomes defective, customers
must contact the Manufacturer for warranty repair or replacement.
One Year Extended Warranty
Certain products offer a One Year
Extended Warranty, in the case of a product purchased being defective,
GearXS.com will exchange for a comparable replacement or the customer
will be given a store credit to purchase an alternative product from our
store. If there are no comparable products available and the customer
requests a refund we may also grant this request.
Please Note: Our one year extended warranty pricing will vary
from product to product. One Year Extended Warranty are effective from
the date that the product is purchased. Once a One Year Extended
Warranty has been purchased, it is non-refundable. Any products
purchased may be refunded if defective but no refund is available for
the Extended Warranty Service.

GearXS.com Return Policy
All third party products purchased from GearXS.com is backed first by
the product direct manufacturer's warranty. GearXS.com's 30 day limited
warranty against defects, may also apply. GearXS.com's 30 day limited
warranty is a defective exchange policy that provides for either repair
or replacement (at our sole discretion) of merchandise that has been
confirmed as defective by either the manufacturer or GearXS.com.
Due to licensing and copyright laws, we do
not accept returns on software once a package has been opened. Defective
software will be exchanged for the same title only according to
GearXS.com's limited 30 day warranty described above.
All returns must be approved by GearXS.com a duly completed returns form
must be completed by the buyer and emailed to GearXS.com for approval,
Returned items without an approval number from GearXS.com will not be
processed. Any shipping and handling expenses on returns without a duly
completed approval will be the responsibility of the buyer..
The customer is responsible for shipping costs, related to the return of
the defective product. GearXS.com bears the cost of shipping replacement
units that are tested as 'defective' via USPS or FedEx only. Expedited
shipping (2 Day and Next Day) is also available but note that the
customer bears the cost of this type of shipping.
Upon receiving the return from the buyer, GearXS.com will examine and test
for the defect, If GearXS.com cannot reproduce the same fault indicated by
the buyer, the return will not be accepted.
All return shipments from GearXS.com will be via ground shipping method or
the equivalent subject to be determined by GearXS.com.
In the event of returning the product, buyer is fully responsible for
the product's safe return to us. Item must be received within 14 days
from the date of the RMA Approval and by insured post.
The return merchandise should include the RMA number that was issued by
GearXS.com, including a signed and agreed Return Policy Agreement Form. All
accessories and manuals must be included inside the package as it was
originally received by the buyer. Return merchandise should be boxed and
well packed. Any missing parts, damaged items or inappropriate
information will not be accepted. GearXS.com will have the right to dispose
of any unidentified return aged over 14 days without notifying the
buyer.
No replacement will be issued on those unidentified returns once it has
been disposed of. Buyer is responsible for the returns shipping cost.
The standard replacement shipping by GearXS.com will be ground shipping or
the equivalent subject to be determined GearXS.com.
LCD Monitor Return Policy
Returns for LCD monitors will only be
accepted if received DOA, damaged or is received with more than 6 dead
pixels. We cannot accept returns if less than 6 dead pixels on the
screen.
Laptop Return Policy
All sales
are FINAL. No cancelled sales will be accepted.
Defective or Not-as-advertised items may be EXCHANGED if you report to
us via RMA Return Request within 14 days of receipt of the item.
If no replacement is available we will process a return and refund.
All laptops sold by GearXS.com are 'opened boxed' unless
specified otherwise. Laptops are non-returnable unless confirmed as
defective by a certified technician.
Refurbished Laptops/Battery Conditions
- All laptops are fully tested by certified technicians prior to selling
on the GearXS website. Prices advertised on the GearXS store are for the
laptop only and not the battery. Due to the age and nature of the
batteries included with the laptops, GearXS does not cover or warranty
the condition or life of the batteries, therefore all prices advertised
are for the laptop only.
Mystery Box Events
GearXS Mystery Box events may include a
satisfaction guarantee warranty. If you are not satisfied with the
products that you received then you may apply for an RMA return request
within 14 days. All Mystery Box Event
return requests must be submitted and received by GearXS within 14
days
from the delivery date. All return requests received after 5 days will
be instantly declined without good reason.
Mystery Box event products are
non-refundable or returnable unless defective or damaged in shipping
(Rules may vary per event, please read the product page for the current
event for any changes in the return policy).
This is an event of chance and luck where customers pay for a Mystery
Box that may reveal anything from simple products such as LED pointer
pens, V220 Cordless Mouse, LED T-Shirt, Bed Sheets to one of our greater
prizes such as a Dell/HP Compaq computer to even a Sony Brava LED-LCD
TV, the prizes are totally random, some customers received prizes under
the $25 value and some received a prize over 100 times the paid value.
Customer agrees to bear all return shipping
costs for approved Mystery Box Event returns (unless stated otherwise).
GearXS will issue a full refund of the purchase price for the products
upon receiving and processing the RMA return. Original GearXS shipping
costs are non-refundable. Any products returned that have already been
opened or used will void all warranties and the RMA return will be
rejected.
Manufacturer warranty
Since the Laptops purchased may be open-box and/or may be previously
sold or registered, they may, or may not include a manufacturer
warranty. Please contact the manufacturer to confirm any warranty
coverage if required.

Product Compatibility / Specification / Color Choices
Buyers are responsible for ensuring the product's compatibility with
their computer systems or electronic device.
Buyers should also be aware that the some products might not be
primarily intended for use in your country or region. Therefore, the
language specification on the device and manual might or might not fully
support the language of your choice. In the event that an English manual
is not available in the particular version that we shipped out, GearXS.com
does not have any obligation to provide a copy of an English manual to
the buyer. However, we do try our best to provide a printed English
manual in most cases or send English manuals via email.
Since the products that GearXS.com sell might not be primarily intended for
your country or region, the product configuration and the related
accessories might not be suitable or compatible in your country or
region. GearXS.com will not be responsible for any incompatibility of the
product and its accessories in your region or country.
Language version, firmware version and color are shipped on a random
basis unless prior arrangement is made by the buyer. Once item is
shipped, no exchange will be granted on language version, firmware
version and color choice. It is the buyer's responsibility to ensure
that they select the correct model, color, firmware on time of order.

GearXS.com will not be liable for any personal injury, physical injury, and
damage caused by the products that we sell.

instruction manual that comes with the product or contact the
manufacturer directly. Any product recalls by the manufacturer will not
be handled through GearXS.com.
Buyers should contact the manufacturer directly for any related
questions or enquiries.
GearXS.com has no obligation to provide technical support on products we
sell, however we will try our best to answer all technical questions to
the best of our knowledge but will not be liable or responsible for
incorrect information or compatibility issues. Please contact the manufacturer for technical and product assistance.
